13 Days to Save Brindi
[fergcorp_cdt]
DAY ONE.
“Canada eliminated the death penalty on July 14, 1976.The last execution in Canada took place on December 11, 1962 at Toronto’s Don Jail.”
Canada is, by all measurable standards, one of the most advanced countries in the world. The Economist ranks Vancouver as the world’s most liveable city, ahead of Vienna and Melbourne. Toronto is number 4.
Canada is the country where the cream of the crop wants to emigrate. A haven of sorts where individual freedoms are respected and communities care for their members.
A model society.
This is what makes Brindi’s story so puzzling and this is the reason why the eyes of the international animal welfare community are now fixed on Canada as a whole and on the city of Halifax in particular.
Brindi is an adopted mutt. She is smart, gentle, affectionate and has passed obedience classes.
On July 24, Brindi was seized and put on death row.
A minor incident, completely distorted by some of the people involved, would lead into a most incredible ordeal for Brindi and her family. Brindi’s owner, Francesca, an American recently emigrated to Canada, found herself tangled in the worst possible plot any animal owner could ever envisage: Her beloved dog, her child, put on death row by the City of Halifax.
There was never an offence charged; Brindi was assessed by an expert and found highly trainable. Thousands of dollars were paid to get the execution order quashed in court. But the city ignored the Law and kept Brindi. Instead of holding a fair hearing to decide whether Brindi presents a true danger (she obviously does not), the city charged Brindi’s owner with 3 by-law violations in a last minute attempt to push for a new kill order.
On the 23rd of February Brindi’s owner was found guilty on all counts.
Sentence hearing will take place on March 9. It is feared the judge will order the Killing of the animal.
We have 13 days to Save Brindi.
History is full of miscarriages of justice.
Brindi’s case is one of those. It was never about the dog.
It was obvious from the beginning that the issue had grown into a personal vendetta, as it is too often the case; a power play where Brindi and her owner Francesca had become mere pawns in the hands of “authorities” clearly more concerned about saving face than about truly pursuing justice.
We have 13 days to Save Brindi.
Today we are launching a local and international campaign to drive public opinion and to prompt the world to take action.
We want each and every one of our readers and the entire international community to stop for a second and think.
Her life is all that Brindi has. We will not allow it to be taken away from her. Think how you would feel if it was YOUR child put in this position. Going through months of isolation while waiting for the moment to be administered a lethal injection and killed. What would you think of Canada every morning if you were in Francesca’s place?
Today the internet and social media have made a new kind of world and a new way to demand justice possible. There are millions of us ready to stand up and fight for what most would consider worthless.. a dog.
However, Brindi is not just a dog. Brindi is a living being, with feelings of sadness, anxiety, fear, longing. A living being that will be executed unless we all stand together and take action.
Starting from today, Brindi is no longer just a dog.
Brindi is now a symbol that represents our most essential values: Justice and the Right to live.
The Universal Declaration of Animal Rights was solemnly proclaimed in Paris on 15 October 1978 at the UNESCO headquarters.
Article 7 states:Any act unnecessary involving the death of an animal, and any decision leading to such an act, constitutes a crime against life.
We need YOU to tell the government of Canada and the City of Halifax that to execute an innocent animal based on obscure by-laws is about the lowest a government can sink into. We will do our best to send a clear message to the Canadian Government and concretely to the City of Halifax; we will show them that doing this would be a terrible mistake, a miscarriage of justice.
We have 13 days to save Brindi and we are going to need YOUR help.
Get involved. We wont give you a model letter to copy and past. We want YOU to speak your mind.
Contact:
Mayor Peter J. Kelly, Mayor of Halifax on ph: 902-490-4010. Email kellyp@halifax.ca and express your deepest inner feelings regarding this case.

I have written a letter and signed the petition when it came around, but I will e-mail again…If he gets euthinized, who knows what will happen next…The government in Canada should not be allowed to do as they please..the sad thing is it’s happening here in the U.S. too…once the government starts making their own laws God knows what will happen. I hope by writing again (and everyone should) maybe things will change.
Nancy Meehan says:
e-mailed & called
Bea says:
I’m sure I’m just being a blind nut again, but I can’t find anything in the write-up saying WHY she was seized and is being held prisoner. What is this by-law that gave the government the right to hold her?
Misha says:
@Bea – there’s a link leading to Brindi’s Mom’s blog in the first paragraph. Here it is again: http://freebrindi.blogspot.com/
It’s a story of complete injustice and full of power games played by the authorities as well as their local SPCA.(let’s recap the their full name Society for the PREVENTION OF CRUELTY to animals). What is being done to this dog and the owner is beyond comprehension and smells of prejudice.
Thanks to everyone for getting involved. We need to make A LOT of noise to save this dog’s life and bring justice to Brindi. So, please take a minute to e-mail or call or both. BE THE CHANGE!

I will write and call again to try to reunite Francesca and Brindi. It is unreal how long this has been going on.
Hoping for a very happy reunion for them both!

Don’t delay – it needs to be done right now as the clock keeps ticking eating away on those precious hours we have left to act.
How much effort is an e-mail when it’s about giving two innocent being their lives back…

Excuse me, but what did the dog do? It seems highly suspicious that this website does not say why the dog is on death row. ???
i’d be happy to support your cause if i knew the dog deserved to be spared. but i don’t know that. i’m supposed to just take your word for it. ???
viktor says:
No Bonni.. this was our first post..
over the next 13 days we will be unveiling the whole story..
in any case here it is for you… all of it.

On January 16, 2009, THE HONOURABLE DUNCAN R. BEVERIDGE of the SUPREME COURT OF NOVA SCOTIA, ruled {Refer to CITATION: Rogier v. Halifax (Regional Municipality) 2009 NSSC14 – DOCKET: HFX No. 3023339 }
(Page 43) (88) Since s.8(2)(d) was the sole basis relied upon by the respondent for the decision purportedly made by Animal Control Officer Hamm on July 24, 2008 that Brindi be euthanized, that decision is without lawful authority and is quashed.
(Page 48) impact on the applicant. It purported to take away her property. The common law has long recognized the principle that no man is to be deprived of his property without having an opportunity to be heard (see Durayappah v. Fernando et al. {1967} 2 All E.R. 152 (J.C.P.C.)
How can a PROVINCIAL court over-ride this decision??
The City of Halifax has crucified Francesca and Brindi since July 24, 2008. The price of a human error has been paid for far too long !!!
I BEG YOU – PLEASE BE COMPASSIONATE AND STOP THIS VENDETTA. RELEASE BRINDI TO HER OWNER, FRANCESCA. BRINDI DOES NOT DESERVE TO DIE!!!

Brindi does not deserve to die based on minor incidents. She is NOT a vicious dog and it has been proven that she is highly trainable. She deserves another chance!!!
I beg you to be compassionate, let Brindi live and release her to her rightful, loving owner “Francesca Rogier”.

Tammy says:
I have also taken action and will continue to be a voice for her til she is sent home. This is just more proof of how disposable animals are in our society. Disgusting. Poor baby, breaks my heart to think of how scared she is now and what she’s going through. Her family too. How sad
Sharon J. Kennedy says:
Canada has become a nation calloused in heart and conscience. We are supposed to be a nation that loves and respects God yet we kill the environment, The Toronto Humane Society abused animals in their care and protection, our cities across the provinces ignore the despairs of the homeless, our children our fed comestibles from the food bank that are 6 months past expiry dates. We are becoming an unholy nation, like Babylon our focus is on gold and greed (Olympic Medals take priority over affordable housing and justice for the impoverished.
All those who love Brindi light a candle and put your prayers and petitions with St. Francis. As Dr. Stanley so wisely counsels….we win our battles on our kness in prayer. Give this Battle to the Lord!
viktor says:
Thanks Sharon…
Continue praying but pls dont forget to call the Mayor on Monday…
Best

Barbara Hanson says:
I called the mayor’s office in Nova Scotia and was told he had no comment. I said to give him the message that the world was watching and that I lived in Colorado. I was told by the woman that answered the phone that she did not care where I lived. Halifax seems like a real unfriendly place. What is happening with Brindi is very sad and has caused such suffering. That can’t be changed, but the outcome of this still could be. Halifax citizens should be outraged that their city is being defamed by a few that want to wield their power in such a manner. What has happened to compassion and humanitarianism? It is obviously not alive and well in Halifax.
viktor says:
thank you Barbara…
You are an example for all to follow.
Honored to have you on board.

Email sent today:
I have now read the total history of the case of Brindi. For authorities to sink this low in a personal vendetta is an act of supreme spite and a national shame to Canada. Why must the animals always pay for the stupidity of man? I believe that in your heart you could turn this situation around. Please do the right thing and stop this horror. Free Brindi – allow this dog to return to its owner. To do otherwise is a travesty of justice and makes Canada the laughing stock of the world.
Misha says:
Thank You for taking the time to send your mail today, Eureka.
That’s what’s so shocking about this case.
Personal agendas, a dog held as a pond, and will likely be killed over this if authorities continue to refuse to be reasonable.
Keep making noise. We are not about to give up or be quiet.
Mayor Kelly will keep hearing from us, won’t he
Marnie Marrone says:
I have submitted a protest letter to the judge. I hope Brindi gets a reprieve. What a terrible circumstance. Good luck.
Misha says:
Thank You, Marnie! Please don’t stop here.
We need to share and repost Brindi’s story with others to create more awareness.

Doreen Marketis says:
Ensure that Truth and Rights are considered in all aspects of this situation, before action is taken that will affect us all, Nationally.
DURIS Virginie says:
Kim Priest-Greene says:
How sad- Good Luck Brindi! This whole episode is just a travesty…
Geraldine TEICHEKMAN says:
THIS Is similiar to BRUCE in nth Ireland ,POWER PLAY aginst THe voiceless, Why don’t humans pickon someone who can make a noise , defend themselves as an equal , I am ashamed to be a homo – sapien .
SAVE BRINDI , SAVE THEM ALL !!
Kurt Bush says:
I’d turn this thing around just to save your own butts if nothing else. There is a lot of people watching…
It was obvious from the beginning that the issue had grown into a personal vendetta, as it is too often the case; a power play where Brindi and her owner Francesca had become mere pawns in the hands of “authorities” clearly more concerned about saving face than about truly pursuing justice.
Wendye Kolles says:
I have e-mailed the Mayor. My prayers and good thoughts are with Brindi and Francesca. We MUST do everything we can to bring them back together. EVERY life is precious. Brindi deserves to be with the person who loves, respects and care for her.
Andrea Rudolph says:
I cannot deal with the stupidity of some people! It’s painful, disturbing and I really have to remind myself constantly that for every uncaring person there are many more kind ones making a difference in this world. For those I share my energy and exchange love for anger… but we still need to talk and work and pray. Brindi I pray for you and yours and bless you for being a teacher for all those that will come after you… in Nova Scotia or anywhere. I ABSOLUTELY LOVED N.S. UNTIL THIS EPISODE.
Misha says:
It’s a sad farce.
Brindi should have never been confiscated in the first place.
Read today’s blog about the SPCA’s role in all of this and be prepared to be disgusted.
As a matter of fact. After you contact Mayor Kelly (again) today, why not let the SPCA know how you feel about their role in Brindi’s kidnapping.

I am outraged by this situation which has gone on far too long and never should have occurred in the first place. Everyone knows that Brindi is not a dangerous dog and that she does not deserve to die. Wake up, Nova Scotia officials, and give Brindi back to Francesca NOW!
SUE says:
What happened to Brindi?
Misha says:
from Francesca Rogier
.…The good news is that Brindi will not be put down. I’m encouraged that the court was reasonable and willing enough to accept expert assessments – that has not happened in the past. And I’m eternally grateful to everybody in this group who wrote letters and made calls. Even though the judge did not read the letters – including the ones that I was told she would accept – it was important to express your opinions. And I appreciate the moral support so much, it really made a difference to me.
However, as we all know, Brindi is not yet free. The judge, perhaps seeking to give HRM some kind of concession, created obstacles to getting her home that are not very clear. As you all know, I have already promised to do training (with her, not separately, as the judge thinks has to happen); I have long since fenced off the house entrances and build a secure outdoor run from which no dog can escape. I asked HRM to approve it over a year ago; now the judge has directed the city to do so. it remains to be seen what they will say.
The conditions of training imposed by the judge are the main source of confusion. It’s why I’ve been sleeping for the past two days, while my brain tries once again to understand the situation. I want to do the training; it was my offer from the start, and I was already in the process of it at the time they took brindi. I am just confused about how it can be done under the present constraints- separately, with Brindi in the pound and without being allowed visits… ?? But when I asked about this in court, the judge passed all decision power to the trainer – who has to be approved by HRM (?). With luck, I will be able to sort things out, hopefully long before August!!
Thank you all most sincerely, and hugs to you all, for being so supportive and loyal through out this terrible ordeal. Thanks also to all who have sent me personal messages since Friday. You’re very impressive!!!….
….
Love and my most sincere thanks,
Francesca
